Under the CAN SPAM Act, commercial emails must include a clear way to opt out, and senders must honor opt out requests within 10 business days. The opt out method must keep working for at least 30 days after the message is sent, and you cannot charge a fee or ask for more than an email address and opt out preferences. The rule applies to business to business email too.

Gmail's sender rules ask bulk senders, those sending around 5,000 or more messages a day to personal Gmail accounts, to support one click unsubscribe through a List-Unsubscribe header for marketing messages, and Google recommends honoring requests within 48 hours. Rules vary by country, for example GDPR in Europe, and change. This is not legal advice.

Why it matters to recruiters

Recruiters and agency business developers send a lot of outreach. A clear opt out keeps you within the law, lowers spam complaints and protects your sender reputation, because people who cannot leave easily tend to click report spam instead. It also respects candidates and clients, which matters in a relationship business.

An example from a recruiting desk

Monthly, an agency emails a salary guide to 3,000 hiring managers. It adds a one click unsubscribe header through its email platform and a plain line in the footer: Not useful? Unsubscribe here. Opt outs sync to the CRM so recruiters do not keep emailing those contacts from their own inboxes, and spam complaints fall below the level they saw before.

Tips that help

  • Put a plain unsubscribe line in every marketing or bulk outreach email.
  • Sync opt outs across your outreach tool, CRM and ATS so they stick.
  • Honor requests quickly, well inside the legal deadline.
  • For one to one cold emails, a simple line such as reply stop to opt out also helps.

Mistakes to avoid

  • Hiding the link in tiny text or requiring a login to unsubscribe.
  • Removing someone from one campaign but adding them to the next one.

Frequently asked questions

Do cold recruiting emails need an unsubscribe link?

If the email's main purpose is commercial, such as selling recruiting services to a client, CAN SPAM requires an opt out. Purely one to one candidate messages about a specific job are less clear cut, but offering an easy opt out is good practice. This is not legal advice.

How fast must I process unsubscribe requests?

CAN SPAM requires honoring opt outs within 10 business days. Google recommends bulk senders honor requests within 48 hours. Most email platforms remove the contact instantly, which is the safest approach.

What is one click unsubscribe?

One click unsubscribe lets the reader opt out from a button the mailbox shows, without visiting a page or confirming. It uses the List-Unsubscribe and List-Unsubscribe-Post headers defined in RFC 8058, and Gmail and Yahoo require it for bulk marketing email.
